These Terms and Conditions ("Terms") govern your access to, use of, and purchases from the Box Car Quilts website located at www.boxcarquilts.com (the "Site"), operated by Box Car Quilts, LLC, located at 3598 Warschun Road, Aubrey, TX 76227 ("we," "us," or "our"). By accessing or using the Site, including browsing, registering an account, or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
1. Use of the Site
Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to use the Site. By using the Site, you represent that you meet these requirements.
Prohibited Conduct: You agree not to use the Site for any unlawful purpose or in violation of these Terms. This includes, but is not limited to: (i) interfering with the Site's operation; (ii) uploading viruses or harmful code; (iii) scraping or copying content without permission; (iv) impersonating others; or (v) engaging in harassment or spam.
Availability: We strive to keep the Site available but do not guarantee uninterrupted access. We may suspend or terminate access for maintenance, security, or other reasons without notice.
2. Intellectual Property
All content on the Site, including text, images, logos, patterns, designs, and product descriptions (collectively, "Content"), is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may view and print Content for personal, non-commercial use only. Any other use, such as reproduction, distribution, or modification, requires our prior written consent.
3. User Accounts
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use at info@boxcarquilts.com. We reserve the right to terminate accounts for violations of these Terms.
4. Purchases and Payments
Product Information: We make every effort to display accurate product details, including fabrics, patterns, kits, and supplies. However, colors may vary due to screen settings, and availability is subject to change. Prices are in USD and exclude taxes, shipping, and handling unless stated otherwise.
Orders: Placing an order constitutes an offer to purchase. We may accept or reject orders at our discretion (e.g., due to stock issues). You will receive an order confirmation email upon acceptance.
Payment: We accept major credit cards, PayPal, and other methods listed at checkout. By providing payment information, you authorize us to charge the applicable amount. All transactions are secure and processed through trusted third-party providers.
Taxes: You are responsible for any applicable sales taxes based on your shipping location.
5. Shipping and Delivery
Shipping Policies: We ship to addresses within the United States and select international locations. Shipping rates and estimated delivery times are provided at checkout. We are not responsible for delays due to carriers, customs, or unforeseen events.
Risk of Loss: Title and risk of loss pass to you upon handover to the carrier.
6. Returns and Refunds
Return Policy: We accept returns of unused, unopened items within 30 days of delivery for store credit (excluding shipping costs). Fabrics cut from bolts, sale items, and custom orders are final sale and not eligible for return or credit. To initiate a return, contact us at info@boxcarquilts.com with your order number.
Refunds: Refunds are only issued for defective or damaged items, or in cases where we shipped an incorrect product. In most other cases, we offer store credit equivalent to the purchase price (excluding shipping fees). Refunds, when applicable, are processed to the original payment method within 7-10 business days after we receive and inspect the returned item. We do not refund original shipping fees.
Exchanges: We offer exchanges or store credit for defective or incorrect items. Notify us within 7 days of receipt.
Classes and Events: All class and event registrations are non-refundable. If you need to cancel, we will attempt to transfer your registration to another available class on our calendar. If no suitable alternative is available, we will issue store credit for the registration fee.
7. Privacy
Your privacy is important to us. Our Privacy Policy, available at [www.boxcarquilts.com/pages/privacy-policy], explains how we collect, use, and protect your personal information. By using the Site, you consent to our data practices as described therein.
8. Limitation of Liability
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or products, even if advised of the possibility. Our total liability shall not exceed the amount you paid for the relevant product or service.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages (including attorney's fees) arising from your violation of these Terms or misuse of the Site.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Denton County, Texas. You waive any objections to venue or jurisdiction.
11. Force Majeure
We are not liable for failures due to events beyond our control, such as natural disasters, wars, or pandemics.
12. Miscellaneous
Severability: If any provision of these Terms is invalid, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any right does not waive it.
Entire Agreement: These Terms, along with our Privacy Policy and any order confirmations, constitute the entire agreement.
